Plain English Explanation
This is a simplified summary prepared by legal scholars to explain this article in clear language. It is not the legal text of the Constitution.
This article gives every Kenyan the Right to a Clean and Healthy Environment.
It includes two important aspects:
- The right to have the environment protected for both current and future generations.
- The right to ensure that all environmental obligations (under Article 69 and 70) are actually carried out.
This is a progressive environmental right that links environmental protection with sustainable development and intergenerational justice.
