The mediators are trained and accredited by the Judiciary, and include advocates, retired judges, and other qualified professionals. The mediation process is confidential, voluntary (subject to court referral), and time-bound, with a typical mediation process concluding within 60 days. If the parties reach a settlement, the terms are recorded and adopted by the court as a consent judgment, which is binding and enforceable. If mediation fails, the case returns to the court for adjudication. The CAM Programme has been rolled out in the Commercial and Family Divisions of the Milimani High Court, the Small Claims Court, the Environment and Land Court, the Employment and Labour Relations Court, and selected Magistrate Courts across the country.
